I recently moved after 3 years from a Duplex. The place downstairs was damaged in Hurricane Ike. I lived upstairs. My Landlady moved from Michigan to my front door steps in a travel trailer and wanted me to put the utilities in my name, write another contract, and demanded that I park our cars on the other side of the driveway. I told her that I was moving, she decided to evict me instead…Needless to say, I won in the courtroom and now I want my $750.00 deposit back. I sent her a demand letter and she refused it. I am not sure what to do now.

Since you won the lawsuit in Texas, you can file an abstract of judgment in the county records of any (or all) counties in Texas. This will show up on the landlady’s credit report and will prevent her for selling property in that county without paying the judgment debt. Issuance will cost about $5; recording will cost about $20.

You can also get the court clerk to issue a writ of execution to take any nonexempt property and to give the proceeds to you. Issuance will cost about $5; constable’s fees will be over $200, but may come out of the sale of the property.
